Getting A Divorce And Filing Bankruptcy Too

Divorce is frequently a painful process, and best completed quickly. However, be careful not to make poor decisions, whether due to emotion or hurry.

Property division is part of any divorce, and support agreements are part of many. If you agree to support obligations thinking you can discharge them in bankruptcy when the divorce is final — think again.

You should settle matters in good faith, i.e., negotiate honestly, intending to do what is agreed. Most divorce debts will remain binding in a bankruptcy, but there are exceptions. If you do need bankruptcy after a divorce, an experienced bankruptcy attorney is an absolute must to be sure you get proper advice on what is and is not dischargeable depending on the chapter you file.

Contact an attorney at the office of Debra Booher & Associates to discuss divorce and bankruptcy issues.

Almost all couples have debts. Your property division will include assignment of debt as well. Be careful what you agree to assume. Your divorce attorney is probably not a bankruptcy attorney. When possible, discussing your bankruptcy options before finalizing a divorce is ideal. But when that’s not possible, it’s critical to seek advice from an experienced bankruptcy attorney to fully understand your options and rights.

Discuss bankruptcy before your divorce settlement. Couples have even reconciled, when financial stressors fade. Whether you want to file for bankruptcy before divorcing or afterward, we can advise couples or individuals. We can determine how and when to file in your best interest.

We handle Chapter 7 and Chapter 13 cases as well. Whether or not you are able to file under Chapter 7, Chapter 13 may be the better choice. Many firms do not handle Chapter 13, but we recognize it as a powerful tool for you.
